I have just spoken with Attorney V. Scott Macom, who is representing Gregory’s Restaurant and Bar in their national battle with behemoth Taco Bell over the use of the catchy slogan “Taco Tuesday.”

This is the first confirmation that both parties have successfully concluded the matter between them.

Independent of my brief conversation with Macom, I have learned and confirmed the following.

Effective today, Friday, October 20, 2023 at 10:00 a.m., the following has been filed in the:

UNITED STATES PATENT AND TRADEMARK OFFICE BEFORE THE TRADEMARK TRIAL AND APPEAL BOARD.

VOLUNTARY SURRENDER OF TRADEMARK

In other words, Taco Bell and others will now be able to use the phrase “Taco Tuesday.”

Gregory Gregory has had the exclusive rights to this winning catchphrase for more than 40 years. Gregory’s Restaurant and Bar has been open since 1946.

I telephoned Macon for a comment, who said:

I have confirmed the filing, a press release is pending. No further comment, said Macom.

Since 1979, Gregory's has sold more than 2 million tacos and counting.

In 1982, the United States Patent Office granted Gregory's the service trademark for "Taco Tuesday."

When you read words that are included in an official settlement, such as “surrender” … it may give the impression that David folded at the hands of Goliath.

That is not the case.

Macom was brilliant in his legal representation of Gregory’s Restaurant and Bar.

Gregory Gregory also handle this extended national spotlight, with great skill and determination.
