Two weeks ago we revealed that Atlantic City Mayor Marty Small and numerous other Atlantic City figures had criminal complaints filed against them.

Craig Callaway has just advised that these are potential indictable offenses, therefore the charges will be heard in New Jersey Superior and not at the municipal court level as he previously believed.

“I am very pleased that these complaints are being treated as it should be treated, which is very seriously. The complaints on all the individuals are indictable and all of them will be arraigned on (Tuesday) June 28, 2022,” said Callaway.

”I am very pleased with the seriousness, the attention that has been given to these very serious charges. Our children’s safety is paramount!” said Callaway.

The signed criminal complaints were previously filed with the Atlantic City City Police Department by former Atlantic City Council President Craig Callaway, along with approximately 6-8 additional concerned citizens.

The complaints named the following people/entities:

  • Atlantic City Board of Education Administrators
  • Elected Atlantic City Board of Education members.
  • The Atlantic City Board of Education solicitor.
  • Monitor for the State of New Jersey Department
    of Education.

The criminal complaints allege a violation of certain state statutes, specifically N.J.S.A. 18 A: 36-24, 18A:36-25, and N.J.S.A 6A:16-11.

Callaway stated that the criminal complaint led were filed with the local Atlantic City Police Department because the crimes being alleged are 4th-degree charges.

The complaint reads that the below mentioned had "knowledge of major inappropriate sexual behavior being inflicted on the children of the Atlantic City Board of Education school district.”

“Specifically, child molestation and pornography by an employee, Kayan Frazier of the Atlantic City Board of Education school district, and this same employee later was employed by an Atlantic City Board of Education contractor, specifically as a substitute teacher," said Callaway

Callaway also stated that the various administrators, elected board members, the board solicitor, and the state monitor failed to report this behavior to the proper authorities,” as per the complaint.

The complaint includes that "Kayan Frazier, recently pled guilty to one Federal count of producing images of child molestation and child pornography.”

  • Former Atlantic City Board of Education
  • Superintendent Barry Caldwell.
  • Gabriel Caldwell
  • Diane Saunders
  • Donald Harris
  • Sherry Yahn, Assistant Superintendent.
  • State Monitor Carol Morris.
  • Former Board Employee Marty Small.
  • Current Board President: Shay Steele.
  • Former Board President and current elected Board
    of Education member: Walter Johnson.
  • Former Board President and current elected board
    member: Patricia Bailey.
  • Current Elected Board Member: Ruth Byard.

Atlantic City Board of Education solicitor Tracy Riley is also named in the complaint.
