
Atlantic City, NJ, Mayor & Wife Child Abuse Criminal Trial is Set
New Jersey Superior Court Judge Bernard DeLury has set a trial date for Atlantic City Mayor Marty Small and his wife, La’Quetta Small, who is Atlantic City Superintendent of Public Schools.
DeLury has set a final pretrial conference for early May, 2025 and the trial is scheduled for mid-May, 2025, for an estimated 10-day trial.
Marty and La’Quetta Small really have no choice but to go to trial.
Because of the crimes they are charged with and the public positions that they hold … A plea deal would not spare them from losing their lucrative, elective and appointed positions.
In a casino gambling town, The Smalls’ will roll the dice and try to win it all at a jury trial.
The evidence against them is voluminous, featuring phone call records, text messages, electronic recordings, physical evidence, hospital records and more.
This is the 3rd time that Marty Small will face an Atlantic County jury. His current record versus the state of New Jersey is 2-0.
Both wins came at the direction of the legendary criminal defense attorney Ed Jacobs, who eviscerated the state of New Jersey in two previous head-to-head encounters.
Jacobs is once again representing Marty Small. However, Atlantic County Prosecutor Will Reynolds is infinitely better prepared than the past efforts.
The Atlantic County Prosecutor’s Office previously released the following public statement about Marty and La’Quetta Small:
On Tuesday, September 17, 2024, Marty Small, Sr., 50, and his wife, La Quetta Small, 47, of Atlantic City, NJ were both indicted for second-degree Endangering the Welfare of a Child. Marty Small, Sr. was also indicted for third-degree Terroristic Threats, and third-degree Aggravated Assault. It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness.
Marty Small was separately indicted for witness tampering by a second Atlantic County jury.
Marty and La’Quetta Small appeared before Judge DeLury earlier today. They are attempting to have subpoenas quashed and damaging evidence suppressed.
Judge DeLury previously denied an identical attempt by Constance Days-Chapman to do the same.
The currently scheduled trial date is interesting timing, as Marty Small is running for reelection in June, 2025, just a few weeks after the trial.
If Small is convicted in May, he’s finished. Should Marty Small be acquitted, it will give him a big boost for reelection.
If La’Quetta Small is convicted, she will lose her position as Superintendent of Public Schools.
Ed Jacobs is the master of delay. It’s certainly possible that the trial could be moved to a later date after the election.
A delay could work against Small as it may be better for him to have disposition of his case prior to Election Day.
