Attorney Says Principal is Being Used to Convict Mayor & Wife

It may be the legal equivalent of a football Hail Mary.

Attorney Lee Vartan is trying to have criminal charges dismissed regarding Atlantic City High School Principal Constance Days-Chapman.

The distinguished New Jersey Superior Court Judge Bernard DeLury is hearing the case.

Vartan is very good at what he does. He has proffered a legal theory that Days-Chapman is basically geing used as a pawn … with the real prize being to convict Atlantic City Mayor Marty Small and his wife La’Quetta Small … who is the Atlantic City Superintendent of Public Schools.

Days-Chapman is currently facing 8 criminal charges, including 5 counts of official misconduct, for allegedly failing to report child abuse allegations.

An Atlantic County Grand Jury indicted Days-Chapman on August 17, 2024 on a variety of criminal counts as follows:

• second-degree Official
  Misconduct.
• one count of second-degree Pattern of Official Misconduct.
• one count of second-degree Endangering the Welfare of a Child.
• one count of third-degree Hindering
  Apprehension of Another.

Vartan has asserted the official misconduct statute has never before been used in this manner.

His motion to dismiss all charges against Days-Chapman was filed on Tuesday, February 4, 2025.

Marty Small is facing multiple criminal charges regarding alleged child abused and witness tampering, specifically:

The Atlantic County Prosecutor's Office has previously confirmed the following:

“On Tuesday, September 17, 2024, Marty Small, Sr., 50, and his wife, La'Quetta Small, 47, of Atlantic City, NJ were both indicted for second-degree Endangering the Welfare of a Child. Marty Small, Sr. was also indicted for third-degree Terroristic Threats, and third-degree Aggravated Assault,” said the Atlantic County Prosecutor’s Office.

Marty Small subsequently indicted by a second Atlantic County grand jury for alleged witness tampering.
