After many legitimate motions and other delay tactics, we have learned that the criminal trial for Atlantic City, New Jersey Mayor Marty Small is set.

Marty Small Criminal Trial Date

Unless another delay occurs, the criminal trial of Marty Small will begin on Monday, August 4, 2025.

The trial judge is the distinguished New Jersey Superior Court Judge Bernard DeLury.

Mayor’s Wife Fought For & Will Receive A Separate Trial

La’Quetta Small is Atlantic City Mayor Marty Small’s wife and the superintendent of public schools for the City of Atlantic City.

La’Quetta Small petitioned Judge DeLury for the right to have a separate criminal trial … apart from her husband (Marty Small). Judge DeLury granted LaQuetta Small’s motion.

This was a big win for La’Quetta Small.

No trial date is set for La’Quetta Small, or, Atlantic City High School Principal, Constance Days-Chapman.

The Criminal Charges

Marty and La’Quetta Small were both indicted on Tuesday, September 17, 2024.

Marty Small Is Indicted For:

second-degree Endangering the Welfare of a Child.

third-degree Terroristic Threats.

third-degree Aggravated Assault.

Marty Small was also indicted by a second Atlantic County Grand Jury for alleged witness tampering.

La’Quetta Small Is Indicted For:

second-degree Endangering the Welfare of a Child.

Atlantic County Prosecutor’s Office Says

It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor's Office.

If Marty and/or La’Quetta Small are convicted … they will forfeit the high-ranking, high-paid public positions.

If they prevail, they will emerge stronger than ever.
