The old expression, “Justice delayed is justice denied,” has long seemed to apply in this case.

Former Atlantic City public schools teacher Phil Eisenstein has been waiting more than 8 years for his day in court.

Eisenstein was unjustly terminated from his Atlantic City teaching position for helping a student who was being bullied.

There was video evidence that supported Eisenstein and the action that he took to protect a student.

There were actually 3 videos. Somehow, 2 out of 3 videos were deleted by the Atlantic City public schools system.

A criminal investigation should have been conducted to rightfully determine how that could have happened. It never was.

Eisenstein was fired by the Atlantic City Board of Education, despite the fact that the New Jersey Child Investigative/Protective Services fully exonerated Eisenstein.

This state agency reviewed 3 videos (while the video existed) of a student altercation that Eisenstein responded to. The state agency cleared Eisenstein.

Back in late April, 2023, Eisenstein and his attorney did make it to a trial before New Jersey Superior Court Judge Danielle Walcoff.

The case never got to the jury, as Walcoff dismissed the case on a hyper technicality.

It looked like Eisenstein had lost his opportunity forever to seek justice against the Atlantic City Board of Education.

However, Swift never gave up and continued to pursue the case on behalf of Eisenstein.

Swift has now (miraculously) won the right to a new trial for Eisenstein versus the Atlantic City Board of Education.

It appears that all Swift has to do now is to make sure that he gets the case into the hands of an Atlantic County jury.

The previous trial was going well, until Judge Walcoff ended it before the jury had the chance to make its will known.

The Walcoff decision has now been reversed and Eisenstein will get a new day in court.
