It was a monumental day for the Atlantic County Prosecutor’s Office.
New Jersey Superior Court Judge Bernard DeLury handed Marty and La’Quetta Small their latest defeat in their criminal child abuse case.
Big Win For The Atlantic County Prosecutor’s Office
You can’t overstate how big this win is.
Marty and La’Quetta Small were trying to have incredibly damaging electronic evidence suppressed.
The electronic evidence was gathered by Marty and La’Quetta Small’s own daughter and her boyfriend.
This was their last, best chance to change their odds.
The Criminal Charges
On Tuesday, September 17, 2024, Marty Small, Sr., (then) 50, and his wife, La Quetta Small, (then) 47, of Atlantic City, NJ were both indicted for second-degree Endangering the Welfare of a Child. Marty Small, Sr. was also indicted for third-degree Terroristic Threats, and third-degree Aggravated Assault. It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor's Office.
A separate Atlantic County Grand Jury also indicted Marty Small on witness tampering criminal charges.
When Will The 3 Criminal Trials Take Place?
There will be three separate criminal trials for Marty Small, La’Quetta Small and Constance Days-Chapman.
When the three trials will begin is anyone’s guess. It appeared that they were headed for either an August 4, 2025 or potential August 11, 20/5 first trial start date for Marty Small.
There is no confirmation regarding the trial schedule … although the early to Mid-August dates don’t appear to be realistic at this time.
Constance Days-Chapman Criminal Chsrges
An Atlantic County Grand Jury indicted Days-Chapman on August 17, 2024 on a variety of criminal counts as follows:
- second-degree Official
Misconduct. - one count of second-degree Pattern of Official
Misconduct. - one count of second-degree Endangering the Welfare of a Child
- one count of third-degree Hindering
Apprehension of Another.
Days-Chapman is the currently suspended principal of Atlantic City High School.
