In an exclusive, on-air interview, Atlantic City, New Jersey Mayor Marty Small has publicly stated for the first time that he would have pled guilty to a crime — with a caveat.

It would only be done by Mayor Small to protect his wife, La’Quetta Small and close friend, Constance Days-Chapman from prosecution.

Atlantic County Prosecutor Will Reynolds blew it. He could have won a conviction versus Marty Small … in exchange for dropping the charges against La’Quetta Small and Constance Days-Chapman … Which is exactly what Reynolds would later be forced to do.

Prior To The Jury Trial — Here Is What Marty Small Was Willing To Do

Mayor Small was willing to plead guilty to two Disorderly Persons offenses, or, one crime of the 4th Degree, along with admission to Pre Trial Intervention (PTI), with no admission of guilt whatsoever.

Any, or, all of these, would have allowed Mayor Small to remain in office. A crime of the third degree or higher, and it would have resulted in automatic forfeiture of elective office. That was unacceptable to Mayor Small and something he would never agree to.

This offer was presented by Marty Small legal defense council Jordan Barbone.

Jacobs never wavered in his legal counsel to Marty Small. Jacobs advised Small NOT to plead guilty to anything.

Jacobs felt that Marty Small never faced any negative potential consequences because his case was a stone cold winner, according to Jacobs.

This was very different from the previous two times that Jacobs represented Small in criminal jury trials versus the state of New Jersey.

In those two cases, Jacobs cautioned Small that if he were to lose at trial, he would be going to jail. Jacobs did not give Small any such warning this time.

It is apparently the only time in Jacobs’ storied career that he has told a client that they had no concern about going to a jury trial. Jacobs was that sure of Marty Smalls’ innocence.

Reynolds mistakenly thought that he had a good case against Mayor Small. He was wrong.

His case unraveled and Small overwhelmingly prevailed at trial.

During our Friday, May 29, 2026 interview, Mayor Small stated publicly for the first time that to end the arduous prosecution (faced by both himself and his wife at the same time) … Small legal counsel (Jordan Barbone) advised the Prosecutor that Marty Small would agree to plead guilty — under the previous terms detailed above in this breaking news report.

However, Small would not agree to resign his public position as Mayor of Atlantic City.

Marty Small agreed to plead guilty to non-disqualifying charges in exchange for all criminal charges being dismissed against his wife and Constance Days-Chapman.

Did Small Ever Think That He Would Lose At Trial?

The above photo is the actual courtroom that the Marty Small trial took place.

I asked Small if was he ever worried that both he and his wife could lose at trial and that their children would face both parents being taken to jail at the same time?

Small stated that he was never worried about himself, however, he went into great detail about how hard this was on his wife, La’Quetta Small.

Small described in detail how he had been through this two other times and that he was equipped to compartmentalize it and go to work every day and do his job.

Third Time Was Not A Charm Versus Small

When Small prevailed on December 18, 2025, with a unanimous jury acquittal, it was the third time that Small has defeated the state of New Jersey at jury trials.
