It’s often been reported that the Mayor of Atlantic City, Superintendent of Public Schools and the Principal of Atlantic City High School are facing serious criminal charges involving child abuse.

What no one has reported about is the potential for jail time and the other penalties that each faces if they are convicted.

First, here are the criminal charges for each:

MARTY SMALL, SR. - MAYOR OF ATLANTIC CITY

  • Second-Degree Endangering the  Welfare of a Child.
  • Third-Degree Terroristic Threats.
  • Third-Degree Aggravated Assault.

Later, Marty Small was indicted by a second Atlantic County Grand Jury for:

  • Witness Tampering.

THE ALLEGED FACTS ARE DISTURBING

The Atlantic County Prosecutor’s Office contends that:

It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor's Office.

An Atlantic County Grand Jury indicted Days-Chapman on August 17, 2024 on a variety of criminal counts as follows:

  • Second-Degree Official Misconduct.
  • One count of second-degree Pattern of Official Misconduct.
  • One count of second-degree Endangering the Welfare of a Child.
  • One count of third-degree Hindering
    Apprehension of Another.

ANY COMPARISON BETWEEN SMALL & MENENDEZ CRIMINAL CASES?

It would appear that the husband and wife duo of Marty and La’Quetta Small are not going to turn on each other … like Robert and Nadine Menendez did during their criminal trials.

The Small duo will be back in New Jersey Superior Court Judge Bernard DeLury’s courtroom on Thursday, May 22, 2025.

The Small’s will request to have separate trials.

DeLury has ruled against The Small’s and Days-Chapman every step of the way … regarding motions to suppress evidence, quash subpoenas, and dismiss their criminal charges altogether.

My hunch is that Judge DeLury will not allow The Small’s to have separate trials … because so much of the criminal evidence depicts them acting together.

JULY 14, 2025 TRIAL DATE?

The Marty and LaQuetta Small trial is scheduled to begin in July 14, 2025.

If past is prologue, the trial start date will be delayed.

WILL DAYS-CHAPMAN FLIP ON THE SMALL’S?

This has loomed over this matter from Day 1. Days-Chapman may be in more peril than Narty and La’Qyetta Small.

Days-Chapman faces unambiguous criminal case facts, such as failure to report, official misconduct, and hindering apprehension.

There is somewhat more nuance regarding Marty and La’Quetta Small.

DAYS-CHAPMAN JUST EARNED DOCTORATE

Days-Chapman has earned her Doctorate degree while on suspension from her position as Principal of Atlantic City High School.

She may never get the opportunity to put all of that hard earned effort to work.

If Days-Chapman is found guilty, she will forfeit her New Jersey teaching certificate, supervisors certificate and will be barred from holding a public education position.

Days-Chapman also faces significant potential jail time. A law enforcement official advised that she could likely face having to serve up to 5 years in prison. That’s time served, not time sentenced.

MARTY & LA’QUETTA SMALL

Marty Small would lose his position as Mayor of Atlantic City and La’Quetta Small would face the same penalties as Days-Chapman.

Both would likely face jail time as well.

In a cruel twist of fate, Days-Chapman appears to be in more criminal danger than The Small’s.
