Judge Removes Atlantic City, NJ Councilman: Here’s What is Next
It really is rarified air to witness a New Jersey Superior Court Judge remove a sitting Atlantic City, New Jersey Councilman from office.
It’s the last thing that a judge wants to do. In the Atlantic City case, presided over by New Jersey Superior Court Judge Michael Blee … he had no other choice.
Before Blee, was the case of Atlantic City Councilman Muhammad 'Anjum’ Zia and whether or not, he actually lives in Atlantic City.
It’s simple. If Zia could have proven that he lives full time in Atlantic City, he would win the residency challenge case and keep his seat.
If the evidence proved otherwise, Blee would have no choice but to remove Zia from office.
In a 63-page decision, Blee removed Zia from office, effective immediately.
Here is the key page of Judge Blee’s decision:
This leaves the Atlantic City Council equally divided 4-4, in terms of their support for or against Atlantic City Mayor Marty Small … although Councilman Bruce Weekes has become a quasi Small supporter. Weekes is currently an unpredictable member of City Council.
Some in Atlantic City are saying that Weekes may run on Smalls’ Mayor - Council at Large ticket next year.
5th Ward City Council challenger Maria Lacca filed the challenge vs. Zia.
Many, likely most did not believe that Lacca would prevail in her challenge to oust Zia. Simply because judges are very hesitating to overturn certified elections, or, remove a sitting councilman from office.
The election of Zia vs. Lacca was a near 50-50 proposition, with Zia prevailing in a very close election result.
About Judge Blee’s decision, Lacca said:
I am delighted to announce that we have emerged victorious in this landmark residency court case, said Lacca. The judge delivered a courageous and decisive ruling today, not only in favor of myself but for Atlantic City. This decision underscores our commitment to justice and the well-being of our community, said Lacca.
A special election will be held to select a new 5th Ward Councilperson.
Lacca intends to run in the special election. Zia is not eligible to run.
Lacca said that Blee’s ruling "affirms the integrity and resilience of our city."
"I extend my deepest gratitude to all those who have supported us during this process," said Lacca. "This victory represents a win and a strong step forward for Atlantic City. I worked tirelessly for the past eight months for this result, and I am ready to move forward to continue fighting the good fight into the 5th Ward special election."
Lacca has pledged to share more details about "this critical special election" as soon as they become available.
Developing.
