
Swift Helps Former Atlantic City Teacher Eisenstein Win New Trial
Atlantic City, New Jersey area attorney John Swift has helped to deliver a big decision in favor of his client, Phil Eisenstein.
Eisenstein is a former Atlantic City public schools teacher who was terminated from his position more than 8 years ago.
A few years ago, Eisenstein’s wrongful termination trial against the Atlantic City public school system was dismissed because of a hyper technicality.
Swift has maintained from the moment the judge announced her decision to end the Eisenstein trial, that he would appeal and help Eisenstein earn a new trial.
Swift kept his word and Eisenstein has been granted a new trial.
This all goes back more than eight years ago, when Eisenstein was fired for helping a child who was being bullied in the Atlantic City public schools system.
The Atlantic City Board of Education turned the situation on Eisenstein and fired him.
Atlantic City Board of Education Member John Devlin implored his fellow board members to not allow Eisenstein to be terminated.
Eisenstein was terminated by the Atlantic City Board of Education even though the New Jersey Child Investigative/Protective Services exonerated Eisenstein.
The state agency reviewed 3 videos involving a student altercation that Eisenstein responded to. The state agency cleared Eisenstein.
Various inside sources have told us for years that these videos totally support the action that Eisenstein took to de-escalate the situation.
For reason still not properly explained, two of the three videos have been deleted by the Atlantic City public school system.
This action should have resulted in a proper criminal investigation. That never took place.
Eisenstein was never permitted to view the videos and his first jury never had the opportunity to review the videos either.
Eisenstein was terminated for just doing his job. He stepped in to assist during a physical altercation between two students. Eisenstein was actually helping one student, who was being bullied by another student.
Atlantic City Board of Education member John Devlin has described the student fights that are occurring at that time as being “the worst in the Atlantic City Public Schools history,” said Devlin.
