It’s the political play of the week.

The State of New Jersey (on their njcourts.gov server) sent out an e-mail on Monday, August 11, 2025 at 3:56 p.m.

It confirmed that the criminal trial of Atlantic City, New Jersey Mayor Marty Small will begin on Monday, November 10, 2025.

The e-mail also confirmed that the La’Quetta Small criminal trial will begin on Monday, December 1, 2025.

Why Is This A Big Deal?

Because Marty Small is running for re-election on Tuesday, November 4, 2025.

The purposeful timing of this trial start date allows Small to run his entire re-election campaign before the disposition of his many criminal charges takes place.

Criminal Defense Attorney Ed Jacobs

Ed Jacobs is a maestro. He has played a brilliant small ball game. Jacobs strategically filed one motion after another.

The Small Team lost every motion, however, with each motion, the ultimate prize was delaying the trial start date.

Few Believed That Small Could Succeed …

… In delaying the start of his criminal trial past Election Day. The strategy worked … with a lot of help from the state of New Jersey.

Atlantic County Prosecutor’s Office

Indicted Marty and La’Quetta Small on Tuesday, September 17, 2024,

Marty Small was indicted as follows:

  • second-degree Endangering the Welfare of a Child.
  • third-degree Terroristic Threats.
  • third-degree Aggravated Assault.
  • A separate Atlantic County Grand Jury indicted Marty Small for witness tampering.

The Atlantic County Prosecutor’s Office publicly stated that:

Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor's Office.

Why Delaying The Marty Small Criminal Trial Matters

Democrats in Atlantic City continue to support Small. They hold a 10-1 advantage over Republicans.

Small is favored to win. If he does, this would allow him to face an Atlantic County jury with the glow of having won re-election.

In other words, he can’t be a bad guy … look, the voters of Atlantic City wants him to be Mayor.

It’s an unrelated (to the criminal charges) situation … yet, it’s a powerful argument that they will try to conflate.

Can Small Delay Trial One More Time?

Never say never. Since Small has succeeded in delaying his criminal trial start date until after his re-election bid … is it unreasonable to think that he could attempt to delay the trial past his inauguration date?

The winning mayoral candidate will be sworn in on January 1, 2026.

it would be a huge advantage if small can delay the start of his trial until after he is officially sworn in for another four year term as Mayor of Atlantic City.

The argument can be made that the voters of Atlantic City have made their determination about his fitness to serve… Should they reelect him under these circumstances.

Marty Small is the recipient of our Political Play of The Week.
