All you have to do is read the New Jersey Superior Court Judge Bernard DeLury decision regarding suppression of evidence.

DeLury appears to have nailed the door shut on Atlantic City Mayor Marty Small, La’Quetta Small - the Superintendent of Public Schools and Constance Says-Chapman - the Principal of Atlantic City High School criminal in their child abuse case.

The plot thickens as Marty Small also faces a separate indictment for witness tampering.

Their criminal trials are now set for July, 2025.

The Atlantic County Prosecutor’s Office has put together one of the most airtight cases you will ever see.

Marty Small, La’Quetta Small and Constance Days-Chapman had placed all of their hopes on getting evidence collected against them tossed.

DeLury rejected the motion in all pertinent ways. He did so in what looks like an appeal-proof manner.

DeLury granted suppression of certain evidence that was collected by the Atlantic County Prosecutor’s Office.

However, it is a hallow victory for the 3 defendants, because the only evidence that DeLury has tossed, isn’t related to this criminal case.

Judge DeLury suppressed cellphone evidence for everything collected before 12/1/23 and everything after 3/27/2024.

It sounds like a big win? But, it’s not. Because the State is allowed to use all cellphone evidence that they collected between 12/1/23 and 3/27/24.

This is all of the real evidence that pertains to the child abuse and coverup. Everything outside of those dates is not relevant and the Atlantic County Prosecutor’s Office never intended to use it in the prosecution of Marty Small, La’Quetta Small and Constance Days-Chapman.

The defendants cannot win on the merits of this criminal case.

That leaves only a successful appeal of DeLury, or, jury nullification as remaining winning paths for the 3 criminal defendants.
