
Atlantic City, NJ, Mayor, Wife & Principal Trials Won’t Be In August
For those who were expecting the criminal trials of three high-ranking Atlantic City, New Jersey public officials to begin in August … it’s not going to happen.
The Three Indicted Atlantic City Officials
Atlantic City Mayor Marty Small is Indicted
- second-degree Endangering the Welfare of a Child.
- third-degree Terroristic Threats.
- third-degree Aggravated Assault.
- A separate Atlantic County Grand Jury also indicted Marty Small with witness tampering.
La’Quetta Small, Superintendent of Public Schools is Indicted
- second-degree Endangering the Welfare of a Child.

Constance Days-Chapman, Principal of Atlantic City High School is Indicted
An Atlantic County Grand Jury indicted Days-Chapman on August 17, 2024 on a variety of criminal counts as follows:
- second-degree Official
Misconduct. - one count of second-degree Pattern of Official Misconduct.
- one count of second-degree Endangering the Welfare of a Child
- one count of third-degree Hindering
Apprehension of Another.
Days-Chapman is the currently suspended from her position (with full pay and benefits) as principal of Atlantic Citv High School.
Our Spotlight On New Jersey Superior Court Judge Bernard DeLury
Judge DeLury has masterfully navigated a myriad of motions to quash subpoenas, suppress evidence, dismiss charges and more.
DeLury’s many decades of public service in the United States military and as a civilian jurist has shined during the process of scheduling three separate criminal trials.
DeLury’s mandatory retirement (at age 70) is fast-approaching.
It would be a disservice to these significant criminal matters if DeLury cannot see all three of the criminal trials to the finish line.
When Will These Three Criminal Trials Begin?
Marry Small, La’Quetta Small and Constance Days-Chapman won’t be making plea deals. They would lose their high-paid public positions … do, that’s not going to happen.
Also, thus far, Small, Small and Days-Chapman have remained loyal to one another … although La’Quetta Small formally requested and did receive (from DeLury) a separate trial from her husband.
That motion Absecon could save La’Quetta Smalk, by separating her from the perception of all of Marty Small’s criminal charges. It was a great move on her part.
Until recently, it appeared that Marty Small would go to trial first … as early as August 4, 2025, or, August 11, 2025.
That is not going to happen.
At this time, no official trial dates have been set. It looks like things are headed well beyond the August, 20/5 timetable.
It also appears headed for a collision with the November 4, 2025 General Election, where Marty Small is on the ballot.
